  cầu nhà nước pháp quyền đã được nhiều viên chức Hà Nội nói từ lâu rồi, chứ
  chưa cần tới các nhà dân chủ phải lên tiếng. Nhưng hiểu pháp quyền như thế
  nào mới là vấn đề. Đó là chưa nói gì tới cách hành xử và cơ chế kiểm tra pháp
  quyền.<br>
  <br>
  Nhà nước cũng nói công khai về pháp quyền, chứ không giấu giếm gì. Thậm chí,
  các nhà nghiên cứu Hà Nội cũng thực sự có suy nghĩ, có phân tích, thậm chí
  còn sử dụng các chữ rất là một thời cấm kỵ như nhóm chữ “xã hôị dân sự”. Thí
  dụ, tìm đọc một bài cũ của GS. Tương Lai, trên tạp chí <i>Nghiên cứu Lập pháp</i>
  ở Hà Nội thời năm 2005 có tưạ đề rất bắt mắt là “Nhà nước pháp quyền và xã
  hội dân sự” - nghĩa là chưa cần đọc, đã thấy có ước mơ dân chủ rồi. Nhưng vẫn
  là luôn luôn có những khoảng cách giữa trí thức (dù là trí thức một thời xã
  hội chủ nghĩa, và bây giờ là đổi mới) và guồng máy chuyên chính rất là xa.
  Thế cho nên, pháp quyền vẫn luôn là chuyện lạ ở quê nhà.<br>
  <br>
  Như bản tin mới tuần qua trên đaì RFA ghi nhận:<br>

  “Quốc hội Việt Nam trong phiên họp hôm thứ Tư 25-7-2007 đã bỏ phiếu bầu lại
  Thủ tướng Nguyễn Tấn Dũng thêm một nhiệm kỳ nữa.<br>
  <br>
  Ông Nguyễn Tấn Dũng được bầu vào chức vụ Thủ Tướng chính phủ vào ngày 27
  tháng 6 năm 2006 trong kỳ họp Quốc Hội khóa 11 năm ngoái.<br>
  <br>
  Theo tiến trình thường lệ, ông Dũng sẽ thay mặt chính phủ mới để nhậm chức
  vào ngày 2 tháng 8 tới đây.<br>
  <br>
  Quốc Hội khóa 12 này cũng chấp thuận cho ông Trương Hoà Bình và ông Trần Quốc
  Vượng lãnh nhận chức vụ Chánh Án Toà Án Nhân Dân Tối Cao và Viện Trưởng Viện
  Kiểm Sát...”<br>

  Xin nói cho rõ, để độc giả hiểu chuyện lạ: ông Trương Hoà Bình là Thứ Trưởng
  Công An, và bây giờ lên nắm Toà Án Tối Cao.<br>

  Theo hồ sơ trên mạng Đại Biểu Quốc hội khoá X, XI , thì ông có họ và tên khai
  sinh là Trương Hoà Bình <o:p></o:p></span></p>

  6.0pt;margin-left:.5in'><span style='font-family:"Verdana","sans-serif"'>Nghĩa
  là bây giờ, theo phân công của Đảng CSVN, ông Trương Hoà Bình sẽ phải làm trò
  phân thân, một kiểu phép lạ của các sư Tây Tạng khi phải cần có mặt ở nhiều
  nơi cùng một lúc. Nghĩa là, sẽ có một ông Trương Hoà Bình ngồi ở Quốc hội
  (tức là chức năng Lập Pháp), một ông Trương Hoà Bình ngồi ở Bộ Công An (tức
  là chức năng Hành Pháp), và một ông Trương Hoà Bình ngồi ở Toà Án Tối Cao
  (tức là chức năng Tư Pháp).<br>
  <br>
  Ai dám bảo rằng cán bộ CSVN không biết biểu diễn thần thông kiểu như các sư
  trên núi Hy Mã Lạp Sơn? Ít nhất, ông Trương Hoà Bình cũng có môn võ Tam Quyền
  Hợp Nhất. Nghĩa là, trong khi thế giới đòi hỏi Tam Quyền Phân Lập, tức 3
  quyền Hành Pháp, Tư Pháp, Lập Pháp phảỉ tách rời, thì ông Bình gom hết về một
  chiêu thôi. Ai không chịu thì cứ theo dân oan mà khiếu nại. <br>
  <br>
  Đúng ra là đã có nhiều người khiếu nại rồi, nhưng laị là khiếu nại các vụ
  khác. Thí dụ, như lời tố cáo của ông Bùi Xuân Sinh trong một thư tố cáo ngày
  5/10/2006 gửi lên “Các đồng chí lãnh đạo Bộ Công an”. Ông viết: <o:p></o:p></span></p>

  TP. Hồ Chí Minh. Với 54 tuổi đời, 35 tuổi ngành, cả cuộc đời tôi giành trọn
  cho Đảng, cho Ngành và không phải hổ thẹn...<br>
  <br>
  Về ông Trương Hoà Bình thì tôi khẳng định là người tài ít, cơ hội nhiều. Dựa
  vào hai ông trùm maphia chính trị Bùi Quốc Huy, Nguyễn Khánh Toàn mà đường
  quan lộ của ông Bình lên như diều gặp gió....<br>
  <br>
  ...Điều đáng ngạc nhiên là ông Trương Hoà Bình luôn khoe khoang là thạc sỹ
  luật, nhưng tất cả mọi người cùng công tác với ông Bình ở A25, Công an TP. Hồ
  Chí Minh, Viện kiểm sát TP. Hồ Chí Minh đều khẳng định ông Trương Hoà Bình
  chưa bao giờ học một trường Đại học chuyên ngành luật học nào cả...“ <o:p></o:p></span></p>

  như lời tố cáo khác từ “Thượng tá Nguyễn Văn Đô - Tổng cục III - Bộ Công an”
  viết “trong những ngày Quốc khánh năm 2006”: <o:p></o:p></span></p>

  tôi đang muốn nói chính là ông Trương Hoà Bình, Thứ trưởng Bộ Công an. Cho
  đến giờ, có không ít cán bộ công an vẫn đang thắc mắc không hiểu vì sao đường
  thăng tiến của ông Trương Hoà Bình lại có thể nhanh như vậy... (...) Ông
  Trương Hoà Bình chỉ bắt đầu thoái hoá, biến chất khi trở thành &quot;trợ
  lý&quot; đắc lực cho ông Bùi Quốc Huy (nguyên Thứ trưởng Bộ Công an, đã bị xử
  lý trong vụ án Năm Cam), khi đó ông Bình là Cục phó A25. Chính ông Bùi Quốc
  Huy đã &quot;đạo diễn&quot; đưa ông Trương Hoà Bình về làm Phó giám đốc Công
  an TP. Hồ Chí Minh nhằm thao túng toàn bộ hoạt động của Công an TP. Hồ Chí
  Minh. Không biết có phải gần mực thì đen không, nhưng đã có rất nhiều vụ án
  đã bị làm &quot;chìm xuống&quot;, bỏ lọt tội phạm...” </BLOCKKQUOTE>Chuyện
  thật hư tranh quyền trong nội bộ công an thì chúng ta không biết hết được.
  Nhưng sự thực trước mắt là cả thế giới đều thấy: ba quyền phân lập chỉ là
  chuyện giễu bất tận ở Hà Nội.<br>

  Chưa hết. Ông Trương Hoà Bình mới đây còn được giao cho nắm Tổng Đàn của võ
  phái lớn nhất Việt Nam và đang có ảnh hưởng toàn cầu: môn võ Vovinam. Bản văn
  nhan đề “Bức tâm thư của Liên đoàn Việt Võ Đạo Úc Châu” ký tên ông Lê Thành
  Nhân – Liên đoàn trưởng VoViNam Việt Võ Đạo tại Úc châu, cho biết chuyện hết
  sức đau lòng: <o:p></o:p></span></p>

  Ngày 17/02/2007, một thế tấn công mới của nhà cầm quyền cộng sản tại Việt nam
  là: ông Phạm Gia Khiêm, Bộ trưởng ngoại giao và ông Nguyễn Danh Thái, Chủ
  nhiệm ủy ban TDTT tuyên bố thừa nhân VoViNam là QUỐC VÕ, đồng thời sẽ nhanh
  chóng thành lập Liên đoàn VoViNam quốc gia, Liên đoàn VoViNam Á châu, Liên
  đoàn VoViNam quốc tế với chiêu bài VoViNam được đưa vào tranh giải tại “Asian
  Indoor Games 2009” tổ chức tại Hà nội.<br>
  <br>
  Với bổn cũ soạn lại, lần này trở thành quốc võ cho nên nghe đồn rằng, nhà cầm
  quyền cộng sản tại Việt nam đã cử một người là Trung tướng Trương hoà Bình,
  Thứ trưởng Bộ Công An làm Chủ tịch Liên đoàn VoViNam Việt nam, vào ngày
  15/07/2007, nếu như không có gì thay đổi vào phút chót. Người ta thường nói,
  ở Việt nam hiện nay, có ba lực lượng chính chi phối là : Đảng cộng sản, Công
  an và Quân đội, như vậy với Trung tướng Công an là Chủ tịch thì Bằng đẳng cấp
  của VoViNam trong nước cấp cho môn sinh sẽ được ký bởi một người chẳng học
  VoViNam, nhưng là Thứ trưởng Bộ Công An, quả là một sự sỉ nhục cho võ học...”

  an rồi, bây giờ lại giao trọn Tổng Đàn võ pháí lớn nhất VN cho ông coi sóc.
  Sao chưa phong cho ông này nắm luôn Hội Nhà Văn, Hội Nhà Thơ, và các giáo hội
  trong nước? <br>
  <br>
  Thế mới biết, cái gọi là pháp quyền lúc nào cũng là chuyện lạ, và cực kỳ khó
